There is now a story running in Newsweek. Can the President Order a Killing on U.S. Soil? In which they quote "anonymous" sources about a a closed-door Senate intelligence committee meeting. Where California Democratic Sen. Dianne Feinstein asked about the extent of presidential powers to fight Al Qaeda; could Bush, for instance, order the killing of a Qaeda suspect known to be on U.S. soil?
Here comes the next tactic "ooohh not only is he listening in on your phone calls but if he doesn't like what he hears he can order your death at the hands of his secret police".

Lets get something straight, and this is going to make a lot of people upset but like it or not these are the facts. The President no matter who he is has the authority to do anything in the name of National Security period. That's the facts. Whether it's listen to your phone calls, order someone held without charges, or order an execution if it falls under National Security he can do it.
The president has the ability due to article two. Article 2 is a DELEGATION of power as commander in chief period. The only check on that is the supreme court and the electorate. Both the congress and the president not only have a right to decide what is constitutional they each have an obligation to do so, and when there is a dispute between the two about what is constitutional ONLY the supreme court can rule on which side is right or wrong. The fisa court in this instance not only does not have jurisdiction it is unconstitutional. The FISA court is in violation of the constitution if it is used to restrict the Commander in chiefs ability to conduct national security period.
Unless the left can PROVE that his authority is being used in a manner other than National Security they are beating a dead horse. If they continue to insist that terrorists should be given rights at home and on the battlefield that they are not entitled to, it is the electorate that will execute them right out of office.
